Tire Defects

All over Florida and across the country, people are injured or even killed in motor vehicle crashes that involve tire failure. A key point is whether the tire failed prior to or during the crash.

"It takes an expert eye, specific knowledge, and meticulous investigation to determine what caused the tire failure and when the tire failure occurred."

Tire failure can be caused by:

  • Improper assembly, poor/weakened materials, improper curing, or other manufacturing defects
  • Improper installation / improper mounting

When tire failures occur, here are the potential results:

  • The driver loses control of the vehicle and possibly crashes into pedestrians, other vehicles or guard rails
  • The vehicle can swerve sharply and suddenly, and possibly roll over

Tire failures lead to auto crashes and often rollovers that can have catastrophic results such as serious internal injuries, head trauma and brain damage, paraplegia, quadriplegia, or even death.

By law (TREAD Act), tire information is supposed to be available to the public – but the National Highway Traffic Safety Administration has not strictly enforced this law and has decided to keep much of this critical data from the public. The information withheld includes warranty claims, production numbers, field reports and even consumer complaints.

Consumers have a right to know if the vehicles they are driving have potential safety flaws that could injure or kill them. Litigation of defective tire cases helps to push our lawmakers and industry “watchdogs” to increase and enforce the standards for the safety of tires on our vehicles.

Ed Ricci's firm served as co-counsel in the National Ford Explorer/Firestone Tires class action lawsuit, where he vigorously pursued economic protection of owners of Ford Explorer and Firestone products.
