Premises Liability

Representing Slip and Fall and Negligent Security Victims in Florida and throughout the United States

Premises liability is a rather vague term that serves as a catchall for many types of events including those involving structural design flaws, unsafe conditions, environmental hazards, improper traffic patterns and a wide range of other issues unrelated to security.

In many cases, security related premises liability matters involve issues such as security standards and generally accepted security practices. In addition to any existing standards, crime statistics, event history, community standards, and specific risk considerations play a part in determining whether an adverse event was foreseeable.

Premises liability cases can occur on public and commercial properties. This includes but is not limited to parking lots, sidewalks, roadways, highways, restaurants, bars, shopping centers, malls, airports, hotels, pools, amusement parks, healthcare facilities, sporting areas, businesses, stores, and more.

All property owners have a duty to maintain their property in a reasonably safe condition. Premises liability cases require that the injured person prove that:

  • The property was in a dangerous condition
  • The owner knew, or reasonably should have known, of the dangerous condition
  • The owner had a reasonable opportunity to identify and correct the dangerous condition
  • The owner caused the unsafe condition, knew about the dangerous condition, but did not take steps to correct it
  • The owner failed to adequately warn of the dangerous condition

Injuries associated with premise liability accidents can be serious and sometimes are not always readily apparent. Injuries can include head, neck, back, shoulder and knee injuries. Injuries like these can prevent an individual from working and can cause financial hardship due to large medical bills and long rehabilitation.
